material that encourages conduct that could constitute a criminal offense; (iii)
any material that violates the rights of others; (d) transmit any material that
contains software viruses or other harmful or deleterious computer code, files
or programs; (e) interfere with or disrupt servers or networks connected to
MWenroll.com service or violate the regulations, policies or procedures
of such networks; (f) access or attempt access to MWenroll.com service,
computer systems or networks connected to the Service, through password mining
or any other means; (g) harass or interfere with another user's full use of
MWenroll.com; or (h) cause, in MWenroll.com's sole discretion,
inordinate burden on MWenroll.com's system resources (i.e. bandwidth).
Proprietary Rights
MWenroll.com hereby grants you a limited
license to use any software provided by it solely in connection with utilization
of MWenroll.com’s services during
the term of this Agreement, and for no other purpose. Upon termination of this
Agreement for any reason, you shall immediately cease all use of such software,
and shall promptly uninstall and delete all copies thereof in your possession or
under your control. Except for the licenses granted herein, you have no
right, title or interest in or to MWenroll.com service or any content.
You agree that MWenroll.com or its licensors retain all proprietary
right, title and interest, including copyright and all other intellectual
property rights, in and to such software. MWenroll.com and/or other
MWenroll.com products and services referenced herein are either
trademarks or registered trademarks of MWenroll.com.
Non-Responsibility; No Warranties;
Indemnification
MWenroll.com is not responsible for circumstances beyond its control,
including, without limitation, actions of third parties, force majeure or other
circumstances.
You agree to indemnify and hold MWenroll.com harmless from and against
any and all claims, costs, damages, losses, liabilities, and expenses
(including, without limitation, attorneys' fees and costs) resulting from or in
connection with your use of MWenroll.com services or breach of this
Agreement.
In the event that, notwithstanding the foregoing disclaimers and
indemnification, MWenroll.com is found responsible to you for any
reason whatsoever, MWenroll.com's responsibility shall be limited to
the amounts actually paid by you for this service, and shall not include
punitive, consequential or resulting damages of any nature.
Changes
MWenroll.com reserves the right to amend the terms and conditions of
this Agreement at any time and shall notify you by posting an updated Agreement
on www.MWenroll.com
and/or by sending you an email message. Continued use of MWenroll.com
service after notice is given of such changes shall constitute your consent to
such changes.
Privacy Policy
MWenroll.com reserves the right to share aggregated demographic
information about our customers, sales, and traffic to our partners and
advertisers. We reserve the right to disclose such information to a third party
only if (a) we have your express written consent, (b) we reasonably believe we
are compelled by applicable state and federal laws, or (c) we reasonably believe
that an emergency involving immediate danger of death or serious physical injury
to any person, or other irreparable injury, including economic interests of a
third party, requires disclosure of the information without delay.
MWenroll.com uses a third party vendor to manage all credit card
processing, and may partner with other parties to provide specific services.
Upon registration with MWenroll.com, we will share names and other
contact information as necessary for the applicable third parties to provide
these services. These parties are not permitted under their contract with us to
store, retain, or use your information for purposes not directly involved with
their service to MWenroll.com. Specifically, our contracts with such
third parties prohibit the third parties from using your personal information
for purposes of marketing or promotions.
Notwithstanding the foregoing, we reserve the right to share personally
identifiable information in connection with an acquisition, merger, or sale of
all or a substantial portion of our business, with or to a company in a
substantially similar business, provided that the other company agrees to comply
with this or with a reasonably comparable privacy policy. In the event of any
such sale or merger, you will receive notice of any changes in such policy.
